No Search Warrant in Recent Raid Following Drug Bust

A Smith County Constable did not have a warrant to search a home during a narcotics sting operation last Thursday. That's what the off-duty jailer's attorney who understands.  His client was shot during the raid.

Smith County Sheriff J.B. Smith says there are circumstances where you don't need a search warrant.

Attorney Rafe Foreman believes volunteer Deputy Mark Waters entered the home on Edinburgh while the woman was asleep.

Authorities say the deputy constable apparently thought the woman was going to shoot him.

The Texas Rangers are still investigating.
