Update: 3 year old hit by truck released from hospital Tuesday

Update: DPS tells KLTV 7 News that the boy was released from the hospital Tuesday.

A 3 year old boy has been seriously injured after being hit by a pick-up truck in the Holiday Hills subdivision just east of Tyler Monday morning.

Police say the boy was chasing after a dog when he ran out in front of a pick-up truck and was hit. A neighbor called 9-1-1 and the boy was transported to East Texas Medical Center in Tyler for treatment.

James Vickery was driving the truck when the boy ran out and says though he tried to avoid hitting him, there just wasn't enough time.

"I drive this road every day, three or four times a day...and all I saw was a green flash, and he was right in front of the truck...I cut my truck to the side to try to miss him, and I knew it wasn't going to do," Vickery said.

Troopers say it doesn't appear that any criminal charges will be brought against Vickery.
