Capital murder charges have now been filed against the man who accused of ambushing a couple at an east Texas restaurant.
Around 10:30 last night, police say, 19 year old Brian Martin Womack of Hudson attempted to rob the manager of the Catfish King on South Medford drive in Lufkin.
Police say Womack shot the manager in the foot.
That's when, police say, the manager's friend got his handgun and fired back, injuring Womack. Officials say Womack exchanged fire hitting the manager's friend.
Womack is still in the hospital this afternoon with non-life threatening injuries. He is under Lufkin police surveillance.
