Tyler Police have arrested DeMontrell Lamar Miller, 21, in connection with the death of two year old Kelynn Pinson yesterday. Miller was charged today with capital murder because the child was under six years old.
After the arrest, Miller's mother and several other family members broke down in front of the police department and had to be taken away in an ambulance.
Linda Brown, who knows Miller, says she doesn't think the murder was intentional.
"I think it was an accident. I know in my heart it was an accident. Only God could tell me otherwise. I know it was an accident."
Miller is the boyfriend of the child's mother. The baby died of blunt force trauma to the head after being found unconscious at Hidden Springs Apartments around 12:45 pm yesterday afternoon. The mother wasn't at home at the time, and Miller was in charge of watching Pinson and Miller's five month old son, who is now in the custody of Child Protective Services.
Miller was taken into custody at the Tyler Police Department around 5:00 pm. He is in the Smith County Jail, held on a one million dollar bond.
