Babysitter Accused Of Murdering 2 Year Old Child

East Texas authorities believe a Henderson County man is responsible for the death of the two year old boy he was supposed to be watching and protecting.  Thursday night Tamara Overturf arrived home from work to find her son dead in the arms of a babysitter.

It happened in Tool, which is in Henderson County, north west of Athens.

37-year old Michael Lyndon Whitman has been charged with capital murder. Authorities said he was responsible for watching the child. This isn't Whitman's first run in with the law. He was arrested in 1994 for Felony Injury to a Child.

The boy's name is not being released, but Tool Police did tell us when they arrived on the scene Whitman was still holding the child.

"He had some bruises, contusions, lacerations," said Assistant Police Chief Martha Decker. Decker said they were all over his body on his arms, wrists, head and back.

"There was enough information. Between medical and statements that we received from individuals to be able to get an arrest warrant and a search warrant," said Decker.

The cause of death has not been determined, and the body has been sent to Dallas for an autopsy.

Police said that when the mother, Overturf, found her son, she suffered some type of a seizure, and was taken to an Athens hospital.

A second child, a 9 year old girl, was also in the home. The little girl is the aunt of the little boy. She has been placed with Child Protective Services until the investigation is complete. Police did say they were able to interview her and are peicing her story with the other interview to try and figure out what happened.

Tool Police, Henderson County Sheriff's Department and Texas Rangers are working the case.
