Criminal Court Upholds Tyler Death Penalty Conviction

The state's highest criminal court has upheld the capital murder conviction for Justin Fuller.

Fuller was sentenced to die for the April 1997 murder of Donald Whittington III of Tyler.

Fuller and three others were convicted for their involvement in Whittington's abduction from his Tyler apartment, and then his murder at Lake Tyler. The motive was money.

Whittington had received from a trust fund. The court's decision yesterday gives the go-ahead for Fuller's execution.
