Phone Scam Suspect In Jail...Again

Police say they have caught the man they believe was targeting hundreds of East Texans on the phone and trying to scam them out of their hard earned cash.

Richard Ramos is charged with public intoxication and theft for his alleged involvement in the scam. Police say Ramos was calling East Texans at random and convincing them he was a relative.  They say Ramos then asked for a hundred dollars or more, saying it was for a friend in need.

Ramos just finished a seven month jail sentence for the same thing, and he has a criminal history that spans 11 pages long. Police say it's frustrating to consistently deal with the same person over and over again, but prosecutors say there's only so much they can do.

"We go down and ask for a sentence that we deem appropriate based on the facts to make sure the victim and the community are protected; but, ultimately, it's up to a judge or a jury. Then, the law is very specific on when a crime can and cannot be enhanced; and, unfortunately, just because a person has a long criminal history doesn't mean that what they're charged with this time is going to be enhanceable," Smith County District Attorney Matt Bingham said.

Because Ramos does have prior convictions, this case will most likely be pursued as a state jail felony. Tyler police are asking anyone who thinks they may have been a victim to contact the department.
