Second Punishment Phase In Capital Murder Trial Set To Start

A Tyler man convicted of capital murder six years ago is about to undergo his second punishment trial, which starts tomorrow.   A Smith County jury is set to determine whether Gregory Russeau, 37, will get the death penalty or spend the rest of his life in prison.  Russeau killed a 75-year-old Tyler mechanic. After his sentencing, the court found that Russeau's Sixth Amendment had been violated.
