What are the legal ramifications of such a widespread recall?
In the state of Texas, if a food kills or injures a pet a company is liable under Texas law.
But we spoke with a Tyler attorney today who says because a pet is considered property, a pet owner can only recover the fair market value of the animal.
"You may pay $100 for a dog. If you could go out and sell it for a $100 that's essentially the fair market value of your pet and what you're legally entitled to recover," says Attorney Randy Roberts with Roberts & Roberts Attorneys at Law.
Roberts says a person could also recover veterinarian bills.
He recommends pet owners work through the manufacturer directly to recover any losses.
