Commissioners Discuss Judge Baker's Decision To Declare County Holiday

Smith County commissioners met for the first time this year and some issues were raised regarding a decision by Judge Joel Baker. Judge Baker declared last Tuesday a county holiday to observe a day of mourning for the late President Gerald Ford.

Commissioners JoAnn Hampton and Joann Fleming wanted to make sure that there was no issue with Judge Baker making the decision on his own, without the commissioners court. "There is a way that they court has to discuss issues and address issues... and this is one of those things because they involve payroll records and things like that, that Commissioner Hampton and I decided to be on the agenda," said Fleming.

The county's attorney said after reviewing state law, that Judge Baker had the right to make a decision on his own -- without the commissioner's court approval.
