The U-S Supreme Court has refused to reinstate the death penalty for a Tyler man's killer.
Gregory Russeau was sentenced to die in 2002 for killing 75 year old James Syverston at his auto repair business.
Last year, the Texas Court of Criminal Appeals overturned the death sentence, arguing that Russeau's sixth amendment right to confront witnesses against him was violated during his trial.
Supreme Court justices made no comment regarding today's decision.
