No Polygraph In Trial Of A Brownsboro Teacher

A loss for the defense today, in the case of an East Texas teacher, accused of having sexual contact with a student, under the age of 17. The defense team of  Danny Burns had hoped the results of a voluntary polygraph test would be admitted into evidence. He was the band teacher at Brownsboro High School.

We learned today in court, Burns passed the polygraph. However, because of case law, the results will not be part of the trial. Burns' defense attorney, John Eastland, says he knew it was a long shot, but wanted to give it a try.

"What we are attempting to do is show the court, and the appellate system, that a polygraph should be admissable in limited circumstances."

Burns also rejected a plea deal from the prosecution. His case is expected to go to trial early this summer.
