The state is suing an East Texas Sheriff's office for not releasing investigative files relating to a policeman's 2005 fatal shooting of a hit-and-run suspect.
Gladewater Officer Bryan Naismith shot and killed Jonathan J. King after a June hit-and-run accident. Investigators say King was shot after trying to run the policeman over after a chase down a dead-end road. Attorney General Greg Abbott today said he's seeking a court order to force the release of records related to the shooting, as requested by King's family. The suit was filed in December.
The A-G's office says the Upshur County Sheriff's Department asked for an exception to the open records law because of a pending criminal investigation. But according to the statement, Sheriff Anthony Betterton did not forward the file to the A-G's office for review as required by law.
Monday afternoon, Upshur County Sheriff, Anthony Betterton told us he has not been served any papers. He says, in Upshur County, the District Attorney handles all open records requests.
