New Orleans Beating Victim Appears In Court Today

A man whose beating by New Orleans police was caught on videotape appears in court today.

Robert Davis is accused of public intoxication, resisting arrest, battery on a police officer and public intimidation. Davis says he was in the French Quarter to buy a pack of cigarettes, when police hit him and threw him to the pavement.

The retired schoolteacher also insists he wasn't drunk. He says he hasn't had a drink in 25 years. Davis and his lawyer also say he wasn't tested for drunkeness after his arrest.

The tape shows Davis being beaten by two officers. A third is accused of grabbing and shoving an Associated Press Television News producer.

The police have all pleaded not guilty to battery charges.
