Guilty Verdict In Injury To Child Case

A Tyler man has been found guilty of injuring his girlfriend's 4-year-old handicapped child.
Thirty-three year old William Waters was accused of severely spanking the boy who has cerebral palsy and is in a wheelchair.

The sentencing phase in the "Injury To A Child" Conviction begins on Friday.
The incident happened in 2002. Prosecutors claim it was done with a belt or with his hands.
Waters did not take the stand but the boy's mother who is now Waters wife, defended him.
She said she was there when Waters spanked her son seven times. She also said she would have stopped waters if she thought the spanking would have caused significant injuries.

The boy's mother and father had recently divorced at the time of the incident.
Pictures of the boy's injuries were shown to jurors. From the pictures, there were a large number of bruises on the boy's body.

An expert witness called by the prosecution said the bruises were consistent with some type of force applied with a blunt object. However, he could not say if it were a hand or belt.
He also said he had never examined the boy but just gave his opinion through pictures.
