TYLER, TX (KLTV) - Accused murderer James Calvert returned to a Smith County courtroom Tuesday, arguing several objections and motions he filed in the latest of dozens pre-trial hearings.

Calvert is accused of killing his ex-wife and kidnapping their son in October of 2012. The Smith County DA has said they intend to seek the death penalty in the case.

In court Tuesday, the court requested Calvert return a list of exhibits he apparently took with his things after last Thursday's hearing. Calvert then requested an ex parte hearing with Judge Jack Skeen. The Smith County judge refused, stating that motions should be discussed before a decision is made.

A court motion to dismiss Calvert's indictment due to prosecutorial misconduct was denied. A second motion, alleging improper investigation in the capital murder case, was also struck down. Upon dismissing the motions, Calvert gets verbal with Judge Skeen, yelling the word 'no' into the microphone to speak over the judge, before he's forced to sit by deputies.

"You're not going to pull anymore of these stunts," said Judge Skeen, in which Calvert replied: "Skeen, I'm done with you man."

Judge Skeen said comments made to the court will be taken up on Thursday. The court will also discuss Calvert's proposed changes in the jury questionnaire next week, when jury selection is expected to begin.
