E. Texas man shot after pointing rifle at firefighters

A Kilgore man was taken to the hospital early Saturday morning after he was shot by the Kilgore fire marshal during a confrontation at the scene of a fire.

Police say Kilgore firefighters responded to a residential structure fire in the 1500 block of Peach Street around 1 a.m. on Saturday. During the process of containing the fire, they noticed a suspicious looking man.

"Upon cleaning up, rolling up our fire hoses, one of our officers noticed a gentleman walking down the street holding a firearm," says Kilgore Assistant Fire Chief Michael Simmons.

The man was identified as 39-year-old Kenny Wayne Davlin, who witnesses say appeared to be very intoxicated. 

"It was discovered that he had a pistol that was taken from him by his wife. He pulled away from the fire marshal and retreated into the residence," Simmons says.

When Davlin came out again, he was pointing an AR-15 rifle at firefighters. Fire Marshal Brandon Bigos pulled his weapons, and shots were exchanged between the two. Davlin was wounded in the shoulder.

Davlin was taken to a nearby hospital. Fellow firefighters say Bigos' actions may have saved many lives.

"I am very proud of my fire marshal. An event that took place could have meant that we were responding to a scene with fatality firefighters and civilians. Due to his quick actions and calmness, he controlled the situation and possibly saved many lives. For that I believe we have a hero in our midst," said Kilgore Fire Chief John Bellows.

Judicial records show Davlin has been previously arrested for assault and DWI. Longview hospital officials say Davlin is in good condition.

Investigators say the fire is being ruled suspicious, and they think it could be connected to the shooting.

Criminal charges for Davlin are pending as officials try to find the reason for his behavior.
