Attorneys spar in Bernie Tiede appeals case

Attorneys for Bernie Tiede and the family of his victim, Marjorie Nugent, continue to spar through legal documents filed in Tiede's appeals case.

Earlier this year Nugent's family filed a request with the Texas Court of Criminal Appeals, asking to address the court before a decision is made about making Tiede's release permanent. Permission was granted and the Nugent family filed a letter with the court in April.

Tiede's attorney, Jodi Cole, then filed a letter in response to the Nugent family's request, stating that all interaction between parties in cases such as this one “has been determined by the legislature to be inappropriate."

On Aug. 21, the Nugent family attorney fired back.

The letter filed Thursday by Attorney Chad Baruch says in the letter that the family's participation in this case is appropriate because “ if a party's pending post-conviction challenge barred a court from hearing from the victim, then any criminal defendant could prevent a victim impact statement simply by filing a notice of appeal minutes after sentencing.”

Baruch asks in the letter, “Who but the Nugent family will speak for the victim?”

Tiede has been out of jail since May, when new evidence in his case revealed that he was sexually abused as a child. Tiede's attorney argue that this new evidence sheds light on why Bernie's allegedly abusive relationship with the victim led him to kill Marjorie Nugent in 1996.
