Police close investigation of Rusk man found in a ditch

RUSK, TX (KLTV) -

The death of a man found on the side of the road in Rusk has been ruled an accident.

In May, Xavier Lang was found injured on Underwood Street just down the road from the Cherokee County Jail. Now, Tracy Justice is still searching for answers in her son's death. "I mean there's got to be something done," said Justice.

His autopsy came back last week and investigators with the Rusk Police Department have decided to close the case. "There is a lot of unanswered questions and not enough investigation I feel," Justice said.

According to the autopsy report, Lang died as a result of blunt injury to the head, his death was ruled an accident because authorities believe he jumped out of the vehicle."At the hospital the doctor told me if Xavier had jumped out of the car they had to be doing 65 miles per hour to have the head injuries he had," Justice said.

Justice says she doesn't know who all was in the car that night, but she believes someone should be held responsible. "How is there no charges to be filed, whether Xavier jumped out of the car there is still failure to render aid, no 911 call," Justice said.

Investigators say the autopsy confirmed what they had already determined and they don't plan on pursing the case any further. Justice says for the loss of her only son that answer isn’t good enough. She says she plans on hiring a lawyer and doing whatever she can until all of her questions have been answered. "I'm not done, I'm far from done," Justice said.

According to the autopsy, Xavier Lang wasn't under the influence of alcohol, but a small amount of marihuana was found in his system.

In March, Lang was arrested during a federal drug bust, and was under indictment for felony possession of a firearm.
