Poll book lawsuit withdrawn, could be refiled

JACKSON, Miss. (AP) - A group of 13 Mississippi residents and Texas group True the Vote are dropping their lawsuit in Mississippi's northern federal court district, saying they will refile it in the southern district.

The group moved to withdraw the original lawsuit Tuesday.

U.S. District Judge Michael P. Mills, in an order filed Monday, writes that parties to case are mostly in the Jackson area and that the plaintiffs appear to have sued in Oxford "based upon political calculations."

The lawsuit seeks to compel Secretary of State Delbert Hosemann and the Mississippi Republican Party to release poll books without redacting voters' birthdates.

Mills writes that crossover voting, though it may violate state law, doesn't appear to break federal law. He also questions whether the plaintiffs were suing the right people for voting records.
