Documents unsealed in Tiede case, next hearing scheduled for March

Bernie Tiede appeared in a Carthage courtroom in front of Judge Diane DeVasto on Wednesday afternoon. Over 40 people, including media, showed up for the hearing.

The hearing was a formality to unseal a writ from Tiede's attorney, Jodie Cole, so they can take up issues regarding new evidence pertaining to sentencing in his case.

Cole announced she would be filing a complete habeus to be presented to the judge with attachments. The new evidence could change Tiede's sentence - Tiede is currently sentenced to life in prison, with the possibility for parole in 2027, for the 1996 murder of Marjorie Nugent, a wealthy Carthage widow. Cole said she would be willing to have a hearing about the full writ if the judge would prefer.

During the hearing, Tiede also affirmed his agreement to have Cole represent him going forward. Tiede had previously been represented by Scrappy Holmes. Cole spearheaded a petition back in 2012 aiming to release Bernie from prison, after she found what she believed to be loopholes that changed his case.

DeVasto requested help from attorneys in gathering all the information and records needed for the case. A new hearing is tentatively scheduled for March.

Court was adjourned and Tiede will be back in court once a revised writ is filed. Until two weeks ago, he had been imprisoned at the Texas Department of Corrections Telford Unit in New Boston, about 100 miles north of Carthage.

There is a pending felony theft charge against Tiede which will be taken up a later date. Cole will represent him in that case as well.
