ETBU victorious in suit against Affordable Care Act contraceptive mandate

Posted: Updated:

An East Texas university wins what they call a major court victory in protecting constitutional religious rights.

On December 27, 2013,  East Texas Baptist University in Marshall was notified that a southern district court judge had ruled in their favor in a lawsuit they had filed against the Affordable Care Act.

Together with Houston Baptist University, the suit was in opposition to the federal mandate requiring employers to provide abortion-causing drugs and contraceptives, something which the school viewed as a violation of the constitution.

"We not only received an injunction against the Obamacare mandate, the HHS, but a judge also found in our favor a request for summary judgement, so that means in the district court it's finished, we won. Of course, we've been fighting for this for two reasons: one, religious liberty, and also our issue is the sanctity of life. We've got to be really careful not to fall asleep on these basic fundamental rights that are guaranteed in the constitution," says East Texas Baptist University President Dr. Dub Oliver.

The federal government may appeal the decision, in which case it would be sent to the 5th circuit court in New Orleans.
