LUFKIN, TX (KTRE) -

A 35-year-old Lufkin man accepted a plea bargain deal of 3 years in the Texas Department of Criminal Justice in connection to an aggravated assault that was allegedly in retaliation for the 2009 beating death of his friend.

Jason Lee Horne appeared in Judge Gerald Goodwin's Angelina County courtroom for "rocket docket" Friday morning. He took a plea bargain on a second-degree felony charge of aggravated assault.

Horne brutally beat Daniel Redd, of Lufkin in August 2012, who was originally charged with second-degree manslaughter in connection to the 2009 beating death of Jerry Hadaway, 55.

According to an arrest affidavit, Inv. Donald Carroll began looking into the case on Aug. 7 at a Lufkin hospital. Carroll spoke with Redd's mother and friend, who said they were at a residence on PD Selman Road on Aug. 5 when they witnessed Horne assault Redd.

The affidavit states Horne was accusing Redd of beating his friend to death in 2009. The witness said Horne started punching Redd and Redd fell to the ground and hit his head on a brick. Horne then started kicking Redd in the stomach with his boots, the witness said.

Records show Redd received a blunt splenic injury with blood loss, which is considered a serious injury.

In an interview Wednesday, Carroll said Horne admitted to assaulting Redd, but he did it because he was angry that Redd had connected him to a burglary that he did not commit.

Carroll obtained a warrant for Horne's arrest on Aug. 9, 2012.

A spokeswoman for the Cherokee County District Clerk's Office said Redd's manslaughter charge was dismissed on March 11, 2013. The charge was dismissed because Redd accepted a plea bargain for a second-degree burglary of a habitation charge and a state-jail felony forgery of a financial instrument.

As part of the plea bargain, Redd agreed to a 3-year prison sentence for the burglary charge and am 18-month prison sentence for the forgery charge. He will be serving the two prison terms concurrently or at the same time.
