Retired Tyler pharmacist James Prosperie, arrested in September and charged with the sexual assault of a teenage girl, appeared in court on Thursday asking for a change in the conditions of his release.

Prosperie, 73, requested that his mandatory drug testing be changed in frequency from weekly to monthly. The judge ruled that weekly visits from the pharmacist's supervising officer should continue, but allowed drug testing to only be required at the officer's discretion.

According to his arrest warrant affidavit, Prosperie sexually assaulted a girl under the age of 17 multiple times during summer break.

In a forensic interview, the victim told police Prosperie made her participate in sexual acts, beginning a couple of weeks after school let out for summer.

According to the arrest warrant affidavit, Prosperie's wife saw her husband "whispering and smiling" at the girl. His wife told investigators "she had a bad feeling about what she saw."

Court documents reveal that the girl told Prosperie's wife that he was sexually assaulting her. Prosperie's wife informed the victim's parents who then filed a police report. A CPS report states that Prosperie "confessed to a lawyer/friend that he has had 'sexual contact' with [the girl] on at least two separate occasions."

Prosperie is ordered to remain at least 500 feet away from the victim or anywhere she may be located at any time. He is not allowed to communicate with the victim or use, possess or consume any alcoholic beverage, illegal drug or narcotic.
