TYLER, TX (KLTV) -

An East Texas man has bonded out of jail after police said he fired a pistol several times from the roof of a downtown Tyler building.

According to the Tyler Police Department, 22-year-old Joseph Scott Mendoza was released from jail Friday morning on a $1,000 bond.

The incident happened around 11:40 Thursday night at the Fair Foundation building located at 121 S. Broadway Avenue. City of Tyler officials confirm they own the building.

Fortunately, police were in the area and heard the shots.

"We made contact with some construction workers that were working on the parking garage there at Broadway and Elm and they advised us that they had observed some subjects on top of the Fair building," said Officer Don Martin with the Tyler Police Department.

Martin said using the description the workers had given them, police were able to locate Mendoza within minutes. Martin said police pulled Mendoza over and searched his vehicle.

"We did locate a gun and realized he was the one that actually went up there and discharged the firearm. We didn't see any damage to anything. We had no one who actually saw them shooting at anyone, so the only charge we had at the time was discharging a firearm within the city limits, which is a class C misdemeanor and then at the time he was stopped he was driving down the wrong side of the street so he was charged with a traffic violation as well," Martin explained.

Martin said Mendoza and three other men used the building's fire escape to get to the roof.

Martin said Mendoza could face an additional charge of criminal trespassing, and while the other men do not face any charges at this time, they too could eventually be charged with criminal trespassing.

Tyler Police said they are working to secure the fire escape to make sure nothing like this happens again.
