Man accused of shooting woman during E. Texas football game now charged with capital murder

GILMER, TX (KLTV) -

The man accused of killing 29-year-old Cheyenne Green at an East Texas football game made an appearance in court Thursday with intentions of getting his bond lowered.

A warrant filed by the Upshur County District Attorney's Office upgraded 32-year-old Jonathan Ray Shepherd's charge to capital murder. A bond deduction hearing was held Thursday for Shepherd. His attorney now dropped a motion that would allow his bond to be reduced and it remains set at $1 million.

"The charge was upgraded to capital murder and thats based on how the investigation has unfolded. He was provided a copy of the warrant, and with that and with all the circumstances surrounding the outpouring of support for the victim i think that was a factor for them. they chose to withdraw the motion," district attorney Billy Byrd said.

Police say on September 26, Shepherd followed Green to her car during halftime at an 8th grade football game in Gilmer in order to hand over the couple's three-year-old son.Witnesses say that an argument occurred between Green and Shepherd regarding who had rights to the child. 

After the argument, Shepherd called his wife and said, according to the witness, "he has done something bad, and he couldn't take it anymore, she is dead and he had killed her." Shepherd asked his wife to go to the parking lot where she'd find the victim's car running and the three-year-old in the back seat. His wife took the little boy, saw Cheyenne lying in blood, and called 911.

Shepherd turned himself in to authorities around 11 p.m. that night. 

At the time of the shooting, investigators say that Shepherd and Green were involved in a bitter custody dispute.
