Photo of stripped student may have far-reaching effects

LAS VEGAS (FOX5) -

A picture of a Durango High School student in nothing but her underwear was blasted all over social media.

What makes matters worse is the picture shows several male students capturing it on their cell phones.

It's not clear if the girl pictured was a willing participant, but what is clear, the students who took the photo and posted it online could face serious consequences.

"I was really sad because I felt for that girl," said Family Therapist Donna Wilburn. "She was being exploited in that moment. One embarrassing moment is going to turn into what could be a traumatizing moment."

Wilburn considers it a form of psychological, even sexual, abuse.

She said students taking embarrassing photos and posting them online happens far more than parents realize.

"I need parents to take this as a reality check," said Wilburn. "You need to talk to your kids about what's okay and not okay."

"This is the world of social media," said FOX5 Legal Analyst Bob Massi. "This is danger of social media."

Massi said what may have started out as a joke is no laughing matter.

He said students and their parents could possibly face criminal and/or legal action involving emotional distress, harassment and invasion of privacy.

"She may have consented to the picture being taken but never consented to the dissemination of the picture. That's an issue."

The school district wouldn't comment on if any disciplinary action was taken but sent a notice to parents that reads in part, "Safety and protection of our students is our highest priority and this matter has our full attention."
