Photos, possible evidence in sex assault case taken from pharmacist's home

Wednesday, authorities were back at the home of a Tyler pharmacist who has been charged with sexual assault of a child.

Tyler police were executing a search warrant at James Propserie's home on Jeff Davis Drive in South Tyler. Crime scene investigators were taking photographs and carrying out large paper bags that could later be used as evidence.

The Tyler Police Department's Don Martin said that this event is part of the ongoing investigation into Properie's case, and that a search warrant was served on the home Wednesday morning. Martin could not say what it is specifically that police are searching for in the home.

Prosperie was not home at the time the search warrant was executed, but authorities did have extra units on the scene and ready to go in case there was an altercation.

Prosperie was involved in a standoff with police on September 3, 2013. According to Tyler Police, officers had gone to Prosperie's home to serve a warrant for aggravated sexual assault of a child at around 11:15 that Tuesday morning. When police arrived, officers noticed movement and were able to confirm the 73-year-old was inside, but Prosperie refused to come out of his house.

Officers on the scene were alerted that Prosperie might be armed and quickly called for backup.

"We asked him to come out of the house, but he would not comply," said Tyler Police's Don Martin. "So we used officers along with some of our on-duty SWAT officers to come down to the area and try and talk him out."

Tyler Police spent about an hour and a half on the scene, calling for Prosperie to surrender unarmed through a loudspeaker and announcing they had a warrant for his arrest. At about 12:45 p.m., the man finally complied and was arrested in his front yard.

Prosperie's wife filed for divorce back in August, and attorneys were in court for the two parties last week and reached an agreement. That final hearing is in December.
