Good afternoon! We hope you're all staying cool and hydrated on this hot, humid day. Please remember to watch out for children and the elderly, who can get overheated quickly, and your pets, as well.

On to your stories for this afternoon:

1. A new bill requires counties with 200,000 people or more to create a prostitution prevention program. Smith County officials are seeking a waiver or variance from the application process for the 2014 fiscal year because they said the county barely meets the population threshold and is not adjacent to a major metropolitan city.Join us for more on that tonight on East Texas News at 6.

2. A Cherokee County deputy arrested a man for animal cruelty after he allegedly shot and injured her dog on Aug. 11. He was charged with cruelty to a non-livestock animal and resisting arrest, search, or transport, which is a felony. More details here.

3. An eastern Nebraska man has sued Walmart, saying the failure of an overfilled plastic shopping bag led to the death of his wife. The lawsuit says the bag failed on April 16, 2010, outside a Walmart store in the Omaha suburb of Bellevue.

4. An Ozone Action Day will be in effect on Friday for Upshur, Smith, Gregg, Harrison and Rusk Counties. Make sure to join Chief Meteorologist Mark Scirto for more on that, the latest burn ban updates, and your most accurate and dependable weather forecast this evening at 4, 5 and 6.

5. A football player at an East Texas college was taken to the hospital Wednesday after he was struck by a vehicle whose driver failed to yield the right of way. Details here.

7. Today, the Obama administration announced two new gun control measures, adding to the list of 23 executive actions President Obama announced following the Sandy Hook tragedy. One will ban the reimportation of military surplus firearms to private entities. The other proposes a regulation that would close a loophole in background checks. In an effort to exercise their second amendment rights, some East Texans are planning an open carry march in Longview this weekend. Join us for that story tonight at 6.
