BOWIE CO., TX (KSLA) -

A judge has granted temporary custody of Nathaniel Richardson's newborn son to his father, while his mother remains in federal custody accused of mailing ricin-laced letters to the president.

Shannon Richardson, 35, is charged with mailing a threatening communication to the President of the United States. She is also accused of trying to frame her husband for the deed.

Nathaniel Richardson has since filed for divorce, and Monday's hearing Bowie County District Court was about custody of their son Brodie, who was born prematurely after Shannon was taken into federal custody.

At the hearing, the judge granted Nathaniel Richardson temporary custody of the child, who is still in the hospital after under going surgery to repair a heart valve. "Brodie is doing very well," says his attorney John Delk. "The judge asked about his progress since the surgery the Surgery did go well and he is starting to gain weight normally and well over two pounds now and growing."

Delk says they are hoping the child will be released from the hospital and into Nathaniel's care by October.

Shannon Richardson remains locked up in an East Texas Jail and was not at Monday's hearing.
