PHOENIX (CBS5/AP) -

A lawsuit by a critic of Maricopa County Sheriff Joe Arpaio over the critic's disorderly conduct and trespassing arrest in 2008 was dismissed on the day the trial was to start.

U.S. District Judge District Roslyn Silver said in an order Tuesday that Randy Parraz was dismissing the case.

The lawsuit alleged Parraz was maliciously prosecuted on trumped up charges after a spat with sheriff's deputies over whether he had a right to be on public property during a county Board of Supervisors meeting. A judge dismissed the charges.

Parraz was a leader in the unsuccessful effort earlier this year to force a recall election against Arpaio.

The Maricopa County Sheriff's Office said other tactics included "launching several protests with hundreds of anti-Arpaio sign carrying activists, bringing live chickens up to the sheriff's office, having a coffin carried by young people to symbolize deaths in the jail and other sophomoric actions that disrupted government."

Arpaio said Parraz must have figured a jury would have seen through his allegations.

Parraz told CBS 5 News he has chosen to not disclose all the factors that influenced his decision.
