East Texas man indicted for murder of wife, shooting of another man

An East Texas man has been indicted for the murder of his wife and the shooting of another man.

Larry Michael Maples, 44, of Ben Wheeler, was indicted for capital murder and attempted murder on Tuesday morning. 

Authorities say the shooting happened around 6 a.m. on March 24 at a home in the 2600 block of FM 16 in Van Zandt County, just east of Canton. 

Officials say 44-year-old Larry Maples of Ben Wheeler called police saying that he had just shot his "wife and her boyfriend."

"This is a senseless murder that will no doubt affect many people in our community, especially his family, and my heart goes out to this family," says Van Zandt County Sheriff Lindsey Ray.

Ray says Maples suspected his wife was at Moses Clemente's home so he parked his car down the road and walked to Clemente's house.

"Maples, after seeing his wife's car parked at the rear of the home, entered the residence through an unlocked door," Ray says.

Maples told officials he found his wife and Clemente inside. 

"We believe he found the couple in a bedroom in the home and they were startled by him," says Ray.

Ray says Maples got into a fight with Clemente, then shot him in the abdomen with a  Colt .45 pistol.

"Maples then shot and killed his wife, Heather Maples, who is 34-years-old from Ben Wheeler," added Ray.

According to Ray, Heather was found shot to death in a bedroom. When EMS arrived, Clemente was also in the bedroom.

Heather's family did not want to go on camera but said Heather and Larry Maples had recently split up. They say Clemente was Heather's friend and they cannot believe this mother of four is now gone.

One of the Maples' neighbors says the family just moved in to this house a few months ago.

"As far as I know, Heather was a good woman and a good mother and the whole story is just really sad."

Heather Maples was pronounced dead at the scene. Clemente was transported to Trinity Mother Frances in Tyler where he is being treated for a single gunshot wound to the abdomen. As of Monday morning, Clemente is still listed in critical condition. Officials say they expect him to fully recover.

According to a marriage license on file at the Van Zandt County Clerk's Office, Larry Maples married Heather on November 20, 2012. Heather's family says Heather and Larry had split up and Heather was staying at Clemente's for safety. Her family says Heather wanted her and her children to be safe from Maples.

"Her dad indicated to me that he did not even know her current husband," Sheriff Ray said. "Some of the family indicated to me that they thought she and Mr. Clemente were still together."

Larry Maples was released from jail earlier in June after the state failed to present the case to a grand jury within 90 days. Maples and his attorneys then convinced a judge to release Maples on his own recognizance. He has been on house arrest.
