Libertarian Party members behind DUI checkpoint video

MURFREESBORO, TN (WSMV) -

Video of a July 4 driving under the influence checkpoint stop has gone viral, and a member of the Libertarian Party was behind the taping.

The video, posted on YouTube, has been viewed at least 2 million times. It centers around drivers' rights at the DUI checkpoints.

The driver is a member of the Libertarian Party, and a number of party members carried cameras with them that night.

"To say he was driving around trying to find a checkpoint, I can't say he did that," said Libertarian Party member Axl David. "A few people said they would keep a video camera, and if they happened through a checkpoint, they would record it and ensure their constitutional right."

The people David was referring to, he said, are members of the Libertarian Party.

"They were recording it because they wanted to insure that the rights of individuals were not being violated," said David.

When the driver refused to roll his window down any further, the deputy asked the driver to pull his car to the side of the road.

Canines searched the driver's car for drugs. When no drugs were found, the driver was allowed to go.

"He should have stood his ground and exercised his right," said David. "He was very compliant. He pretty much voluntarily exited the car. The argument can be made whether did he leave the car on his own or was he forced out. I don't know."

David said the DUI checkpoint for this driver went a step further.

"We believe the he checked every indicator to determine there was no intoxication, yet he decided to continue on as a narcotic checkpoint, which is against the law," said David.

Legal expert David Raybin also viewed the video and had a different take on the driver's behavior.

"This guy is immediately becoming confrontational and noncompliant with the officer for no reason," said Raybin. "So the officer is allowed to escalate this a little further. This is not the way to react to a police command to move."

The Facebook page for the Rutherford County Sheriff's Department is no longer available. A sheriff's spokesperson did not comment on the Facebook page, but did tell us Friday that the department is reviewing the incident to determine if any police or procedures were violated.
