CINCINNATI, OH (FOX19) -

A local free speech case has found its way to federal court.

Attorneys for Forest Thomer, of Cold Spring, have filed a lawsuit against the City of Cincinnati for false arrest, malicious prosecution and deprivation of constitutional rights.

Thomer was arrested in 2012 after an incident at Party at the Park. He asked attendees if they wanted "laugh at his crippled friend."

His friend, Allison Bruener, has muscular dystrophy and he was trying to promote her upcoming comedy show.

Thomer was acquitted in November of disorderly conduct.
