TYLER, TX (KLTV) -

The father of an East Texas toddler, who was found dead in a septic tank, was back in court Friday morning.

During the trial, the state requested that the two child endangerment indictments for David and his wife Sabrina Kimbley be joined.

The Kimbley's were indicted on child endangerment charges for allowing their oldest son to live in an insect infested residence. David and Sabrina Kimbley are each charged with thirteen counts of child endangerment pertaining to their surviving children, who were reportedly living in filthy conditions.

In August of last year, the Kimbley's 2-year-old son Jake was found dead in the family's septic tank in Winona, 12 hours after he was reported missing. The cause of death remains undetermined.

The indictments are designated for trial on Monday, June 3. A pretrial hearing has been scheduled for May 17 at 8:30 a.m.

At that time the defense can file a motion to sever the indictments.
