PD: Man pleads not guilty to double shooting after fight over sex act

An Arizona man pleaded not guilty to murder in an April shooting that left one man dead and a woman wounded.

Marshon Garth, 23, made the plea on Wednesday morning at his arraignment on charges of first-degree murder, aggravated assault and kidnapping.

Officers were called for a reported car crash into a tree in the area of 3800 West Pollack about 4:30 p.m. April 30 and then learned it was a shooting case.

Phoenix Fire Department officials say when crews arrived at the scene, they found a man dead in the vehicle. He was later identified as Michael Gauer. They also discovered a woman with multiple gunshot wounds to the legs and abdomen. She was rushed to a local hospital.

Investigators said they learned the woman was working as an exotic dancer and met Garth at a nearby residence, where she agreed to perform a sex act in exchange for $400, police said. Afterwards, Garth and the woman began arguing about the payment, police investigators said. 

At that point, the woman called her boyfriend, Gauer, to help her leave the home. As they were leaving, police said Garth opened fire on the couple.  Gauer was fatally hit and crashed into a tree as he tried to flee the area.

Police sent in the SWAT team.

Several neighbors heard and saw the commotion. One neighbor even shot video right after the crash.

"We ran in the house and came back out to look, and there was one deceased in there and one shot," said neighbor Nicholas Bradine.

"All the cops, they had the whole area taped off and a couple of people had been shot. Everyone was running outside to see what was going on, and once they figured out they didn't know where anybody was, they kind of ran back inside," said neighbor Bryan Way.

Garth's next court date is scheduled for July 10.
