Several East Texans join suit against Carnival

East Texans have joined in a federal lawsuit filed Thursday against Carnival Cruise Lines for problems they experienced on the crippled Triumph ship last month.

A fire in the ship's engine room on February 10 forced the ship to be stranded for several days in the Gulf of Mexico. Onboard, toilets were overflowing and passengers were forced to use the bathroom in bags. Guests slept in makeshift tents constructed with sheets on balconies.

The federal lawsuit has 17 plaintiffs, including a couple from Gun Barrel City and their four children along with a mother from Tyler who traveled on the ship with her two daughters.

The suit says Carnival Cruise Lines was negligent for letting the ship sail with a recent history of problems. The suit also claims fraud, misrepresentation and a breach of contract for Carnival not delivering a "four-day leisure cruise that included safe passage on a seaworthy vessel, adequate and wholesome food, adequate drinking water, and sanitary and safe living conditions."

Each plaintiff in the suit is mentioned with the specific problem they experienced on the Carnival Triumph.

The family from Gun Barrel City was staying in two inside cabins on Deck 10 of the ship. They claim their handicap-accessible cabin had toilets and showers overflowing with urine and feces that flowed through the room as the ship listed. The family says they relocated from their interior room to a makeshift tent. According to the suit, one of the children, ran a fever of 102 degrees for two days. The parents are listed as experiencing ‘dizziness and feelings of falling' aboard the vessel.

The family says they had to strap their 8-year-old son into a wheelchair and transport him up and down stairs until his wheelchair broke. The family is suing for that damage, lost earnings at work, along with physical and emotional illness.

The mother from Tyler was vacationing with her two daughters and staying in an interior cabin on Deck 2. Their toilet and shower overflowed with urine and feces, forcing them to move to lounge chairs under a makeshift tent on Deck 9.

The woman claimed the smell of the waste onboard the ship made her stomach upset. She also claims to have experienced ‘mental anguish and emotional distress.

Among the items listed in the suit, the woman is asking for damages for falling ill, along with lost earnings from her job.

The 17 individuals who filed the suit have requested a jury to hear their case.
