Convicted felon disappears during court recess, warrant issued

Officials in the 7th District Court in Tyler say a Mesquite man did not return to court after a lunch break on Thursday.

According to the court coordinator, Nicky Charune Agnew was in court on Thursday morning for his trial for possession of a controlled substance. A recess was called and Agnew was to return from lunch at 1 p.m., but he never showed up. 

The trial continued without Agnew and the jury found him guilty and sentenced him to life in prison. Judge Kerry Russell issued a warrant for Agnew's arrest. 

On March 22, 2011, Texas Department of Public Safety officers stopped Agnew's vehicle on Interstate 20 headed east. A police canine made a 'hit' on the car and 76 grams of cocaine were found in a secret compartment in the vehicle.

Agnew was released on $75,000 bond on March 23, 2011 and then rearrested in August 24, 2012 for insufficient bond. He was released the next day on $150,000 bond.
