Sheriff's office investigating deputy constable-involved shooting


A deputy constable is on paid administrative leave following a weekend shooting. The constable's office says this is a standard procedure.

The incident happened in the parking lot of Outlaws night club in Southeast Smith County. The club is located on highway 110 between Tyler and Whitehouse.

Right now there are two investigations underway. One investigation is being conducted by the Smith County Sheriff's Office, as they would investigate any shooting that takes place in the county.

The other investigation is an internal one, being conducted by the Smith County Constable's Office for Precinct 1.

According to officials, 20-year-old Ricky Bruno was being escorted out of Outlaws club by an off-duty deputy constable who was working security. Officials say Bruno then got into his car and attempted to drive into the deputy constable. The officer fired two shots at the vehicle in return. When the sheriff's office finishes their investigation, they'll turn those results over to the district attorney's office.

"What we're looking at here, is... there was a discharge of a firearm and a vehicle was shot," says Smith County Sheriff Larry Smith. 

"We're just investigating that incident and once we get our investigation completed, we will provide that information to the district attorney's office. They will make a decision as to if anything else further needs to be done and if it was a justifiable shooting," Smith says.

Authorities say Bruno was not struck by any of the shots, but his vehicle was. He did crash that vehicle into a nearby ditch. He was arrested and charged with aggravated assault with a deadly weapon and evading arrest with a vehicle. As of Monday evening, Bruno was still in the Smith County Jail on an $80,000 bond.
