Whitlock resigns as constable as part of plea agreement

LOUISVILLE, KY (WAVE) - A Jefferson County Constable is serving one year of probation and has officially resigned as constable after accepting a plea agreement for shooting a woman accused of shoplifting.

David Whitlock will serve one year in a diversion program instead of a five-year jail sentence, but his legal troubles are not resolved. Judge Brian Edwards scheduled a restitution hearing for December 19.

While leaving court on Friday, Whitlock spoke publicly for the first time since the incident. "I'm glad it's over. It's been a rough year," he said. Whitlock declined to answer additional questions.

Whitlock made an Alford plea in January on second-degree assault and first-degree wanton endangerment charges. An Alford plea means a defendant does not admit guilt but concedes there is enough evidence to convict.

Whitlock shot Tammie Ortiz at a Walmart in Pleasure Ridge Park in 2011. Ortiz asked for $3,000 in restitution for damage to her vehicle that occurred during the shooting. Ortiz did not face charges for shoplifting following the incident.

Ortiz also filed a civil lawsuit against Whitlock and Walmart, alleging the store used Whitlock's constable services and even went as far as calling Whitlock's mobile phone the day of the shooting. Ortiz is suing for battery, negligence, property damage and unlawful imprisonment.

Whitlock can never again seek a law enforcement position as part of the plea agreement.
