CPS records set to be released as attorneys prepare for Kimbley trial

The parents of a child who was found dead in a septic tank back in August were in court on Friday for a pre-trial hearing.

David and Sabrina Kimbley of Winona stand charged with 13 counts each of child endangerment. Prosecutors say the Kimbleys were raising their children in unsafe and unsanitary living conditions.

In August, 2-year-old Jake Kimbley was found dead in the family's septic tank 12 hours after he was reported missing.

In court, prosecutors told the judge that releasing some of the children's Child Protective Services records would be necessary for the trial. Redacted versions of those records were brought into the courtroom. The Kimbley's criminal charges are not related to Jake's death.

The cause of Jake's death has not been determined. A request for a copy of Jake's autopsy from the Dallas County Medical Examiner was blocked by the Smith County District Attorney's Office because the case is still under investigation.

The Kimbley's trial is expected to begin March 13.
