Upshur County Commissioner out of jail after holding ETX Game Warden at gun point

UPDATE: According to Upshur County records, Precinct 3 Commissioner Lloyd Crabtree and Todd Allen Crabtree were both released from the Upshur County Jail Sunday morning. Their bonds have been set at $40-thousand dollars.
An Upshur County Commissioner was arrested Saturday evening after he held an East Texas Game Warden at gun point.
According to Upshur County Jail records, Lloyd Crabtree was arrested and charged with aggravated assault against a public servant. This stemming back to the scene near Big Sandy where officials responded to reports of a possible hostage situation. Also arrested was 28-year old Todd Allen Crabtree. He was also arrested and charged with aggravated assault against a public servant.
Mike Cox is an information specialist with Texas Parks and Wildlife. He said State Game Warden Shane Bailey went onto the private property of the Crabtree family to do a routine check of hunters.
"He was confronted by three armed men who pointed their weapons at our Game Warden and actually came up and disarmed him," Cox said.
The Game Warden used his cell phone to call 911 for help. Officials responded to the scene and were able to safely release the Game Warden. The Crabtrees were arrested and taken to the Upshur County Sheriff's office.
A family member said his loved ones were protecting their home, but authorities say state Game Wardens have rights even when it comes to private property.
"All Texas Game Wardens have statutory authority to enter public or private land if they believe there is hunting or fishing. They have the same statewide authority as a state trooper," Cox said.
Internal affairs of Texas Parks and Wildlife along with the Texas Rangers are investigating the situation.
Officials have also added that State Game Wardens have authority to check any property in TX where there's game or fishing, whether its private property or public.
No injuries were reported. The bond on both men has not yet been set.
Lloyd Crabtree is currently the Upshur County Commissioner for Precinct 3. Crabtree's term is due to expire at the end of the calendar year. Crabtree was also charged with oppression and abuse of official by capacity of a grand jury in December of 2011, but those charges were later dropped.
