According to the Gregg County Sheriff's Office, Investigator Douglas Morgan went to the home of a Kilgore man, Jesse Smith, 33, to follow up on a CPS report of sexual assault of a child and possession of child pornography.
Investigator Morgan reported that when he arrived at the home, he spoke with the suspect, Jesse Smith, and asked him if he had a cell phone. When Smith said he did, Morgan asked Smith if there were images of child pornography on the phone, and again, Smith said yes.
Morgan asked Smith for consent to search his phone, and Smith agreed and signed a consent to search form.
There were images on Jesse Smith's phone of children ranging in age from 2 years old to 17 years old. The children were photographed in various sexual acts with other children and with adults.
Smith was then asked for consent to have his bedroom searched, and he agreed and told Investigator Morgan that he would find a cigarette box containing Ativan and Clonazepam that a friend had given him to help him sleep.
Investigator Morgan did find the narcotics, and then placed Smith under arrest for Possession of Child Pornography and two counts of Possession of a Controlled Substance.
Smith was read his Miranda rights, saying he understood and agreed to answer questions. Smith was asked if he had ever abused a child and he said yes. He admitted to touching the two-year-old child of a friend and taking pictures of the child during the crime with his phone.
Smith was booked into the Gregg County Jail on charges of Possession of Child Pornography, Aggravated Sexual Assault of a Child, and Possession of a Controlled substance <28 grams.
