Constable Rust resigns, replaced by Blackmon

SMITH COUNTY, TX (KLTV) -

A Smith County Constable has turned in his resignation effective Tuesday at midnight.

Precinct three constable Dustin Rust says he has accepted another supervisory law enforcement position elsewhere. Rust declined to say where he would be working and what he would be doing.

Rust says he waited for the precinct three constable's race to be over so commissioners could appoint whoever won the election as the new constable. Smith County Commissioners will take up the issue in court Tuesday.

Rust says August marked his fourth year serving as constable and that it was time to move on.

Rust still faces criminal charges brought against him in Smith County for allegedly operating a security company without a license, misuse of county equipment and theft. Rust's next court hearing is August 20, 2012.

At Tuesday's commissioners court, Rust was replaced by Constable Jim Blackmon, effective at midnight until December 31.
