PALESTINE, TX (KLTV) -
An East Texas DPS trooper is accused of DWI while his two young children were in the car.

Dana House resigned from his law enforcement position a week ago after his arrest. He had served as a DPS trooper in Palestine for 12 years.

Anderson County District Attorney Doug Lowe says the arrest comes as a surprise, especially considering House's history.

House testified in hundreds of DWI cases. Now, his vantage point in the courthouse will be a little different. He's charged with the same crime.

"I will tell you as far as people who testify he did regularly testify in our courts," said Lowe.

Lowe says they may request another prosecutor to handle House's case. Lowe has cross-examined House countless times.

"We're going to seek out the judges advice and we're going to reflect on it in our office to see what impact it's going to have, but I will tell you if our office did decide to prosecute him he will not be treated different than anybody else," said Lowe.

Authorities say House was caught driving drunk with his two children on U.S. 287 near Armory Road. Lowe says the arrest surprised him.

"There's a personal level here," said Lowe. "Obviously, you saw the picture of Dana with the rest of his troop here in the office. So when something like this happens, it does affect our relationship. But I expect that we'll go through this and we'll live through it and Mr. House will live through it."

House is out of jail on a $500 PR bond.
