Constable turns himself in to Smith County Jail

A Smith County Constable has turned himself in to the Smith County Jail just hours after warrants were issued for his arrest.

Constable Dustin Rust turned himself in Tuesday evening to the Smith County Jail. Rust was accompanied by other people, including his father, Donn Rust. 

Dustin Rust told our news crew on the scene that he "would see you guys on the way out". 

Rust says he has learned the district attorney's office is in the process of issuing three warrants for his arrest.

Rust confirmed on Monday that he has been indicted on charges of theft and misuse of county property.

Constable Rust has been under investigation since four deputies were accused of using county gasoline while working on a private security patrol in Tyler.

Monday night Constable Rust told us "It's not what it seems. We're going to trial. They've offered me many, many deals to try to get out of this. I'm willing to sacrifice my law enforcement career to bring out the truth in Smith County."
