Dr. Naples To Be Released on Bond

A federal judge has decided that accused East Texas doctor, James Naples, is not a flight risk. Naples is a foot doctor in the Texarkana area and is the lead doctor named in this case. Naples and five other doctors are accused of giving cancer patients toxic chemicals as treatment. Three employees who work for the doctors are also named in the 134-count indictment, which also includes charges of health care fraud.

Today, prosecutors in Tyler argued that the two suspects have the motive and means to flee the country. But the defense won today, so Naples and his employee Linda Velvin are set to be released from the Bowie County Jail after meeting certain conditions. The judge ordered Naples to post a $100,000 cash bond. Both suspects must surrender their passports and stay within the Texarkana area.

Defense attorneys say they're pleased with the judge's decision.

"The evidence that the court heard, they're not flight risks," Scrappy Holmes, attorney for Velvin, said. "They're lifetime connections to the Texarkana area -- their homes, their families, their businesses."

The judge set a date for jury selection and trial to begin May 4.
