Smith Co. Authorities: Man kills stepson during family disturbance

TYLER, TX (KLTV) - One man was killed in a shooting Sunday Afternoon in Smith County.

According to the Smith County Sheriff's Department, William Kirton, 67, shot his step son, Audy Murphey around 2:44 pm, after Murphey had been verbally abusing his mother, 64-year-old Nannette Kirton and his step father and tearing up their residence for most of the day.

When deputies arrived at the residence on Dry Creek Road, they found Murphey dead in back doorway of the residence.

According to authorities, when Mr. Kirton came out on the back porch he saw Audy standing over his mom, yelling at her; and that is when Kirton got a 9 mm handgun and shot Audy in the chest.

Audy was well known to deputies as he suffers from mental illness and when he is off his medication gets a little rowdy. Murphey has a criminal history for Assault, Terroristic Threat, Criminal Mischief, DWI, Vehicle Theft and Unlawful Carrying of Weapon.

William was not arrested and the case will be presented to a grand jury for review.

At the time of his death he had a pending Class C Assault in Smith County.
