Driver not yet charged in incident that injured 3-year-old ETX child

HENDERSON COUNTY, TX (KLTV) - A three-year-old child is out of the hospital after she was hit by a car in Henderson County.
Authorities say even though the driver in this case did stop, criminal charges are not out of the question.

Three-year-old Ashia Miller was playing in a driveway when a neighbor hit her with his SUV.

"He ran over me...the front tire and the back tire," Ashia says.

Family says she has a fractured elbow, bruises and swelling.

They say they're thankful she's ok, but frustrated that the driver has not been charged.

"You run over a three-year-old child and not even 24 hours later you're out in the streets?" Ashia's mother Kasandra McCarty says.

"We don't want to falsely charge someone of something if it was just pure accident. I'm not saying it was an accident. I'm saying we've got to determine that," Henderson County Sheriff Ray Nutt says

Henderson County says they're still trying to determine if and what charges will be filed.

"There was some evidence of alcoholic beverage and due to that fact we got with the district attorney's office and got a search warrant for blood," Sheriff Nutt says.

DPS says blood test results could take anywhere from days to months to come in.
Officials say the driver is 47-year-old Shannon Murray.
A quick records search showed Murray has been arrested multiple times for DWI and in 2002 plead guilty and served jail time.

"We're working on it right now as we speak," Sheriff Nutt says.

"Why can't you hold them in jail until you get all of your tests and all of your screenings back? Because there's where he belongs," Kasandra says

Officials say regardless of test results Murray could be charged with injury to a child, but right now it's too soon to tell. They say currently they're conducting more interviews while the investigation continues.
