A 6-year-old boy shot in the back by one of his brothers is now out of the hospital. That's according to the Cherokee County Sheriff's Department. The alleged accident happened yesterday afternoon at the family's home on CR 2310, about 5 miles south of Rusk. The boy and his two brothers, ages 7 and 10, were home alone at the time of the shooting. Authorities say Children's Hospital in Dallas released the boy last night without performing surgery to remove the bullet. They say leaving the bullet lodged inside the boy will cause less damage at this time.
Child Protective Services says it never sought custody of the child. The Cherokee County Sheriff says his office will not file charges.
